This Personal Data Confidentiality Policy (hereafter referred to as Confidentiality Policy) is
applicable to the information which can be obtained by the particular web site where the text of such Confidentiality Policy is posted, and which is about User, and any software and products located
there.
1. DEFINITION OF TERMS
1.1 The following terms are used in this Confidentiality Policy:
1.1.1. "Web Site Administration" is employees authorised for the Web Site management and acting
on behalf of it; they organise and/or carry out the personal data processing, and determines the goals
of the personal data processing , the composition of the personal data to be processed and actions
(operations) performed with the personal data.
1.1.2. "Personal Data" is any information related directly or indirectly defined physical person
(personal data subject).
1.1.3. |"Personal data processing" is any action (operation) or a cumulative action (operation) carried
out with or without automation facilities on personal data, including acquisition, recording,
systematisation, accumulation, storage, adjustment (update, change), retrieval, use, transfer
(distribution, delivery, access), depersonalisation, blocking, deletion, destruction of the personal
data.
1.1.4. "Personal data confidentiality" is a mandatory requirement to be met by the Web Site
Administration prescribing preclude any intentional distribution of the data without consent of the
personal data subject, or availability of any other legal foundation.
1.1.5. "Web Site User" (hereafter referred to as User) is a person having access to the web site via
the Internet and using the web site for his/her purposes.
1.1.6. "Cookies" is a small data fragment sent by a web server, stored in the user's computer and
forwarded by the web client or web browser to the web server in HTTP request at the attempt to
open a page of the respective web site.
1.1.7. "IP address" is a unique network address of a node in a computer network arranged on the
basis of IP protocol.
2. GENERAL PROVISIONS
2.1. Any use of the web site by the User means agreement with this Confidentiality Policy and the
conditions of the User's personal data processing.
2.2. In case of disagreement with conditions of the Confidentiality Policy, the User must terminate
any use of the web site.
2.3. This Confidentiality Policy is only applied to this Web Site. The web site administration neither
controls, nor is liable for any third-party web sites which can be accessed by the User via the links
provided on this web site.
2.4. The web site administration does not check the validity of the personal data provided by the
web site User.
3. THE SUBJECT OF THE CONFIDENTIALITY POLICY
3.1. This Confidentiality Policy establishes the Web Site Administration obligations on intentional
non-disclosure of the personal data provided by the User on various requests of the Web Site
Administration (for example, for dial-back, for booking an excursion, etc.).
3.2. The personal data allowed for processing hereunder is provided by the User by filling in special
forms on the web site and usually includes the following information:
3.2.1. User's full name;
3.2.2. User's contact telephone number;
3.2.3. other data.
3.3. The Web Site Administration shall also take efforts for protection of the Personal data data which is
automatically transmitted when the web site pages are visited:
IP address;
information from cookies;
Information about the browser (or other software accessing the web site);
access time;
addresses of visited pages;
referrer (address of the previous page), etc.
3.3.1. Disabling cookies may result in inability to assess the web site.
3.3.2. The web site acquires statistics of its users' IP addresses. This information is used for the
purpose of troubleshooting, for check of the correctness of the performed operations.
3.4. Any other personal information which was not mentioned above (watch history, used browsers
and operating systems, etc.) shall not be subject to intentional disclosure, except for the cases
stipulated by the law.
4. PURPOSES OF THE USER'S PERSONAL INFORMATION ACQUISITION
4.1. The Web Site Administration may use the Personal Data for the following purposes:
4.1.1. User identification, for ordering and/or contracting.
4.1.2. Providing the User with access to personalised resources of the web site.
4.1.3. Establishing feedback with the Web Site User concerning the Web Site use, provided services,
processing of requests and applications from the User.
4.1.4. and other purposes stipulated by the law.
5. PERSONAL INFORMATION PROCESSING METHODS AND TIMEFRAME
5.1. The User's personal data shall be processed without any time limits, by any legitimate method,
including processing in the personal data information systems with or without use of any automation
facilities.
5.2. The User agrees that the Web Site Administration may transfer personal data to third parties,
including courier services, postal service organisations, telecommunication providers solely for the
purposes of satisfying the User's requests posted on the Web Site within the framework of the
Public Offer Agreement.
5.3. The User's personal data may only be transferred to authorised governmental authorities on the
grounds and according to the procedure established by the applicable legislation.
6. OBLIGATIONS OF THE PARTIES
6.1. The User undertakes:
6.1.1. to provide correct and true information about personal data required for the Web Site use.
6.1.2. to update of supplement the provided information about personal data in case of any change of
such information.
6.1.3. to take measures for protection of access to his/her confidential data stored on the Web Site.
6.2. The Web Site Administration undertakes:
6.2.1. to use the received information solely for the purposes indicated in item 4 hereof.
6.2.2. not to disclose the User's personal data, except for items 5.2 and 5.3 hereof.
6.2.3. Block personal data related to the respective User since the time when the User, his/her
legitimate representative or authorised body for personal data protection applied for it or requested
it, for the check period, in case of revealing any invalid data or illegal acts.
7. LIABILITY OF THE PARTIES
7.1. The Web Site Administration shall be liable for any intentional disclosure of the User's
Personal Data in accordance with the applicable legislation, except for the cases stipulated by items
5.2, 5.3 and 7.2. hereof.
7.2. In case of a loss or disclosure of the Personal Data the Web Site Administration shall not be
liable, if such confidential information:
7.2.1. had become known to general public before it was lost or disclosed.
7.2.2. had been received from a third party before it was received by the Web Site Administration.
7.2.3. was received by third parties by means of an unauthorised access to the Web Site files.
7.2.4. it was disclosed with the User's consent.
7.3. The User is liable for lawfulness, correctness and validity of the provided Personal Data in
accordance with the applicable legislation.
8. SETTLEMENT OF DISPUTES
8.1. Before filing a lawsuit in court arising from the relationships between the Web Site User and
Web Site Administration, a claim (a written proposal of a voluntary settlement) shall be lodged.
8.2. The claim recipient shall notify the claimant about the claim consideration results within 30
calendar days after receipt of the claim.
8.3. If no agreement is achieved, the dispute shall be transferred for consideration to a judicial
authority in accordance with the applicable legislation.
8.4. The applicable legislation shall be applied hereto and to the relationships between the Web Site
User and Administration.
9. ADDITIONAL CONDITIONS
9.1. The Web Site Administration may amend this Confidentiality Policy without the User's
consent.
9.2. A new Confidentiality Policy shall enter into force since the time when it is posted on the Web
Site, unless otherwise stipulated by a new revision of the Confidentiality Policy.
